FILING REQUIREMENTS.

 

To file a Trademark Application in Italy we require:

 

  1. Applicant(s): Full name, nationality and address.

  2. List of goods/services: According to the International Classification of Goods and Services (Goods: Classes 1 to 34. Services: Classes 35 to 452).

  3. Reproduction of a Trademark: In case of a design trademark with a drawing or a word trademark with special display, a reproduction of said trademark (photo, drawing, etc.), is required. We can take care of preparing the electrotype and prints ourselves, with no additional charges.Preferably you can send us the mark in an electronically editable form (e.g. file .jpg ot .tiff) as attachment file to our mail address (euromark@europatent.it)

  4. If priority is to be claimed under the Paris International Convention, we need:

a)   Precise information on the country and the date of each basic Application, which shall be stated at the filing of application in Italy. Information of the serial number(s) may be filed later (4 months from date of filing Application).

b)   Document of priority: unlegalized certified copy of each basic Application is required. If not in Italian, a full translation shall also be supplied. These documents may be filed within four months from date of filing Application in Italy.

  1. Power of Attorney signed by the Applicant(s): When an Application is filed by a Company, the Power of Attorney shall be signed by a legal representative of the Applicant Company; the position of the signer within the Company shall be given. No legalization is required.

          Term for late filing: 2 months (6 months for priority document)

 

PROCEDURE MAIN DETAILS.

 

Examination: All applications are subject to formal examination only by the Patent and Trade Marks Office. After that, they are published in the Official Bulletin for opposition purposes.

 

Registration: When the Examiner decides that there are no reasonable grounds of rejection, he issues a decision for registration. Duration: 10 years from the date of application, with privilege of renewal for 10-years periods.

 

Delivery of official certificate of registration: Ordinarily, certificates of registration are issued approximately 12 to 18 months after filing of the application.
