STANDARD PATENTS AND UTILITY MODELS

 

FILING REQUIREMENTS

 

To file a Standard Patent (or Utility Model) Application in Italy we require:

 

  1. Applicant(s): Full name, nationality and address.

  2. Inventor(s): Full name, nationality and address.

  3. When the Applicant is not the Inventor: Information on the derivation of the Applicant's right to patent (e.g. the Inventor is employed by the Applicant, assignment from Inventor, agreement, assignment of priority rights, etc.)

  4. Specification with claims in Italian: If they are not in this language, we shall have to do their translation. Specifications and claims shall be filed together with the Application.

  5. Abstract of the invention: It shall not exceed 150 words. It may be filed later (two months from Official Action).

  6. Drawings (if any): One set of drawings, on clean white paper, clear black lines.

            Dimensions: International paper size A4 = 29,7 x 21 cm. The minimum margins (which            shall remained unframed), are as follows:

            top:                  2,5 cm              right:     1,5 cm

            bottom:            1,0 cm              left:       2,5 cm

 

            Remarks concerning the drawings:

-          You can either send us the formal drawings ready for filing at the Italian Patent  Office, or we can have the formal drawings prepared by our own draughtsmen from the informal drawings you send to us.

 

  1. If priority is to be claimed under the Paris International Convention, we need:

a)      Precise information on the country and the date of each basic Application, which  shall be stated at the filing of application in Italy.

b)      Document of priority. unlegalized certified copy of each basic Application is required. If not in Italian, a full translation shall also be supplied.

  1. Power of Attorney signed by the Applicant(s): When an Application is filed by a Company, the Power of Attorney shall be signed by a legal representative of the Applicant Company; the position of the signer within the Company shall be given. No legalization is required.

          Unextensible term for late filing: 2 months.

 

PROCEDURE MAIN DETAILS.

 

Patents:  Patents of invention are granted for new inventions, which involve an inventive step and are susceptible of industrial application, for a term of 20 years from date of application.

 

Utility Models:  Utility Models are granted for a period of 10 years from the date of the application in respect of invetion that confer on an object form, structure or constitution that results in an appreciable improvement in its use or manufacture.

 

PATENTS AND UTILITY MODELS

 

Examination:  Patent applications and utility model application are subject to examination for form and patentability requirements. Novelty and inventive step are subject to an examination "prima facie" without search examination.
